| TERMS AND CONDITIONS OF SALE |
- GENERAL
These conditions of sale apply to all sales of products manufactured and or distributed by the Company (Australian Poly Specialists Pty Ltd) or shown on its quotations, invoices or similar unless specifically varied in writing.
- TERMS OF PAYMENT
Shall be offered by the Company and accepted by the customer by signing the relevant application. Non-compliance with terms will result in cancellation; otherwise all transactions shall be cash.
- PRICES
All prices are subject to change without notice, although the Company will endeavour to give 30 days notice. All published list prices are recommendations only and there is no obligation on the part of the reseller.
- RETURNS
All returns for whatever reason must be made within 14 days from date of invoice. A restocking fee of up to 15% can be applied to cover restocking costs. Goods of special, fabricated or "ordered in" nature are not acceptable as returns.
Any goods used or damaged are not acceptable.
- FREIGHT
The Purchaser acknowledges that the Company shall be entitled to make a separate charge for freight in the case where goods are delivered by the Company's own transport.
- DELIVERY
The separate charge for freight referred to in Clause 5 hereof shall be on the following terms:
(a) all charges are F.O.B. from the Company's warehouse to the Purchaser's nominated point of delivery unless otherwise stated; and
(b) the Company accepts no responsibility, for the late delivery of any goods.
- INSURANCE
The Purchaser acknowledges that the Company does not in its normal course of business insure any goods in transit against loss or damage and such insurance shall be the responsibility of the Purchaser.
- WARRANTY
The Company undertakes to replace at its own cost and option any article proved under proper care and use, to be of own faulty manufacture in accordance with the appropriate Australian Standard. The Company's liability is limited in all cases to crediting or replacing faulty articles free of charge. In the case of goods not manufactured by the Company, the manufacturer's Condition of Sale will apply to those goods and the Company will not be subject to any liability whatsoever.
- GOODS RECEIPT
While all goods dispatched are checked for quality, type and quantity, it is the customer's responsibility to check the receipt and to advise immediately details of any variation.
- TITLE LIEN
Ownership of the equipment shall remain with the Company which reserves the right to dispose of the equipment, until payment of the full purchase price thereof and any other moneys due to the Company under the agreement.
